Welcome to RealEstateAI (“the App”), published by FastTrackAI, LLC (“Company,” “we,” “our,” or “us”). By downloading, installing, or using the App, you agree to be bound by these Terms and Conditions. If you do not agree, do not use the App.

End-User Acknowledgment (Summary)

- License: You’re getting a license to use the app, not ownership of it.

- Subscriptions: Premium features are available through monthly or annual subscriptions, with a free trial. Subscriptions renew automatically unless canceled in advance.

- One-Time Purchases: Some features may be available as one-time, non-refundable purchases (subject to platform rules).

- AI Generated Content: AI-generated outputs may contain errors, omissions, or misinterpretations. AI outputs (transcripts, summaries, property reports) are for informational purposes only. You are responsible for verifying their accuracy before using them professionally.

- No Professional Advice: RealEstateAI is not a broker, lawyer, or financial advisor. Always consult licensed professionals before making real estate or legal decisions.

- Compliance: You must ensure your use complies with all applicable real estate laws, MLS rules, and privacy regulations.

- Updates: The app may update or change features at any time. Continued use means you accept those updates.

- Liability: The Owner is not responsible for indirect damages, errors in generated content, or non-compliance with local laws.

Full Terms and Conditions

1. License

The Software is licensed, not sold. The Owner (FastTrackAI, LLC) grants you a non-exclusive, non-transferable, non-sublicensable, limited right to use one copy of the Software for your personal or professional use on a single device. No ownership or title to the Software is transferred, and this agreement should not be construed as a sale of any rights.

2. Restrictions of Use

You may not copy, distribute, reverse engineer, decompile, disassemble, modify, rent, lease, resell, sublicense, or otherwise transfer the Software except as expressly permitted by the Owner. Any attempt to do so is void.

3. Copyright and Intellectual Property

All rights, title, and interest in the Software remain with the Owner. You agree not to remove or obscure copyright, trademark, or other proprietary notices contained in the Software.

4. Disclaimer of Warranty

The Software is provided “AS IS” without warranties of any kind. The Owner disclaims all express or implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. You assume all risks arising from use of the Software.

5. Artificial Intelligence Disclaimer

RealEstateAI uses artificial intelligence and automated transcription/summarization technologies. While we strive to ensure quality and accuracy:

• AI-generated outputs may contain errors, omissions, or misinterpretations.

• The Software may produce inaccurate, incomplete, or misleading summaries, transcripts, or reports.

• Generated outputs are intended only as aids to productivity, not as substitutes for independent review or professional judgment.

• You remain solely responsible for verifying accuracy, completeness, and compliance before relying on any AI-generated content for professional or client-facing use.

The Owner disclaims any liability arising from reliance on AI-generated content without independent verification by the user.

6. Limitation of Liability

To the fullest extent permitted by law, the Owner shall not be liable for any indirect, incidental, consequential, or special damages arising out of use of the Software. For one-time purchases, liability shall not exceed the purchase price. For subscriptions, liability shall not exceed the fees paid for the most recent subscription period.

7. Privacy and Data

Your use of the Software is subject to our Privacy Policy, which can be found in the application or on our website.

8. Indemnity

You agree to indemnify and hold harmless the Owner against claims, damages, or expenses arising from your use of the Software or your breach of this EULA.

9. Professional Disclaimer

The Software is intended for productivity purposes only. It is not a substitute for professional advice, including legal, financial, or real estate services. You should always consult licensed professionals for such matters.

10. Subscriptions and One-Time Purchases

Subscriptions
- Free Version: Limited access for an unlimited period.
- Free Trial: A free 14-day trial providing full access. Cancel before expiration to avoid charges.
- Premium Subscriptions: Offered on a monthly or annual basis. Subscriptions renew automatically unless canceled in advance. Refunds are not provided for partial periods.

One-Time Purchases
- Final and non-refundable, unless required by law.
- Valid as long as the Software remains supported.
- Platform-specific terms (Apple App Store / Google Play Store) apply.
- Purchases are tied to your account and non-transferable.

11. Application Content

The Software’s outputs (including transcripts, summaries, and property reports) may be evaluated during the free trial or refund period available from the marketplace partner. Continuing beyond this period constitutes acceptance. Generated content is for informational purposes only and may vary depending on device, platform, or account. Users are solely responsible for reviewing and verifying outputs before relying on them professionally.

12. Real Estate Disclaimer

The Software does not:
- Verify or guarantee the accuracy of MLS data, contracts, or financial information.
- Provide brokerage, investment, or legal advice.
- Act as a licensed broker, agent, or attorney.

Decisions related to property transactions should be made only with qualified professionals.

13. Compliance With Local Laws and Regulations

You are solely responsible for ensuring your use of the Software complies with:
- Real estate licensing requirements.
- Fair housing and anti-discrimination laws.
- Client data privacy and confidentiality rules.
- MLS or other listing service regulations.

The Owner disclaims all liability for non-compliance.

14. Limitation on Use of Generated Content

All outputs generated by RealEstateAI:
- Are for informational purposes only.
- May contain errors, omissions, or inaccuracies.
- Are not legally binding contracts, disclosures, or marketing materials.

You agree to independently verify all outputs before use in professional or client-facing contexts.

15. Updates and Modifications

The Owner may release updates or modifications at any time. Updates may add, change, or remove features. Continued use after updates constitutes acceptance.

16. Changes to Terms

The Owner reserves the right to modify these Terms at any time. Updated Terms will be posted in the Software or on our website. Continued use after updates constitutes acceptance.
