End User License Agreement and Terms of Service

These Terms of Use and End User License Agreement ("Terms") are a legally binding agreement between you ("User," "you," or "your") and FastTrackAI, LLC, a Florida limited liability company ("FastTrackAI," "Company," "we," "our," or "us").

These Terms govern your access to and use of FastTrackAI's applications, websites, software, artificial-intelligence features, and related services, including FastTrackAI: Smart Notes, RealEstateAI™, ShelterAI®, their mobile and web versions, and other applications or services that FastTrackAI may offer now or in the future (collectively, the "Services").

By downloading, accessing, creating an account for, subscribing to, or using any of the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and Accounts
You must be legally capable of entering into a binding agreement to use the Services.

Certain Services require an account. FastTrackAI uses Google Firebase Authentication to support account management across all three applications, including Sign in with Apple, Google Sign-In, and guest access.

You are responsible for maintaining the security of your account and for activity conducted through it.

You agree to provide accurate information when creating or maintaining an account and to promptly update information that becomes inaccurate.

You may not use another person's account without authorization or allow unauthorized persons to use your account.

Guest accounts may have different functionality, account recovery options, or data persistence limitations than authenticated accounts.

2. Scope of License
Subject to these Terms, FastTrackAI grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for their intended purposes.

For applications distributed through Apple's App Store, this license permits use on Apple-branded products that you own or control, as permitted by applicable Apple Media Services Usage Rules, including applicable Family Sharing, volume purchasing, or similar rights required by Apple.

The Services are licensed, not sold.

Except where prohibited by applicable law, you may not:

• Copy, modify, distribute, sell, lease, sublicense, or create derivative works from the Services.

• Reverse engineer, decompile, disassemble, or attempt to derive source code from the Services.

• Circumvent security, authentication, subscription, credit-metering, or usage restrictions.

• Use automated systems to access the Services in a manner that places unreasonable demands on our systems.

• Use the Services to violate applicable law or another person's rights.

• Use the Services for fraudulent, harmful, abusive, or unlawful purposes.

3. Our Applications and Services
FastTrackAI develops applications for different industries and use cases using a shared technology platform.

FastTrackAI: Smart Notes
FastTrackAI: Smart Notes is designed as a consumer productivity and documentation application for recording, transcribing, summarizing, and organizing meetings, conversations, appointments, interviews, ideas, and other information.

RealEstateAI™
RealEstateAI is designed to assist real estate professionals with documentation, conversations, observations, inspections, summaries, and related activities.

ShelterAI®
ShelterAI is designed to assist animal shelters, rescues, veterinary teams, fosters, volunteers, and other animal welfare professionals with documentation, transcription, summaries, reports, observations, and related activities.

FastTrackAI may introduce additional applications, websites, features, platforms, or services. Unless separate terms are provided, these Terms apply to those Services as well.

4. Artificial Intelligence
The Services use artificial intelligence and related technologies for transcription, summarization, organization, report generation, and other functions.

AI-generated output may contain errors, omissions, incorrect interpretations, or other inaccuracies.

AI-generated content is provided as a productivity and documentation aid and should not be treated as independently verified information.

You are responsible for reviewing information generated by the Services and determining whether it is accurate and appropriate for your intended use.

5. You Remain in Control
FastTrackAI's Services are designed to assist you, not replace your judgment.

Unless a particular feature expressly states otherwise, AI-generated summaries, reports, notes, and other outputs are not automatically submitted to third-party record systems, made part of an official record, or acted upon independently by FastTrackAI.

You determine what happens to the output. You may review it, edit it, correct it, share it, export it, copy all or part of it into another system, or choose not to use it.

You are responsible for reviewing important information before relying upon it or placing it into an official, professional, medical, veterinary, business, real estate, or other record.

6. Professional and Specialized Information
The Services are documentation and productivity tools. They do not provide legal, medical, veterinary, financial, real estate, or other licensed professional advice.

ShelterAI
ShelterAI does not diagnose animals, prescribe treatment, or replace veterinary care or professional veterinary judgment. Users should carefully review medical information generated or transcribed through ShelterAI, including medication names, dosages, diagnoses, test results, treatment instructions, dates, and follow-up recommendations.

RealEstateAI
RealEstateAI is not a licensed real estate broker, agent, attorney, financial advisor, inspector, appraiser, or other licensed professional. Users remain responsible for compliance with applicable laws, regulations, contractual requirements, fair-housing requirements, professional obligations, confidentiality requirements, and rules applicable to their business or profession.

FastTrackAI: Smart Notes and Other Services
Information produced by FastTrackAI: Smart Notes or other Services should be independently reviewed when used for medical, legal, financial, business, professional, safety-related, or other consequential purposes.

7. Recording Other People
Some Services allow you to record conversations or import recordings.

You are responsible for obtaining any notice, permission, or consent required by applicable law before recording another person.

Recording and consent laws vary by jurisdiction. A conversation may involve participants located in different jurisdictions with different requirements.

FastTrackAI does not determine whether a particular recording is lawful.

You agree not to use the Services to record individuals unlawfully or in violation of applicable privacy rights.

8. Your Content
You retain your ownership rights in recordings, photographs, documents, text, notes, prompts, custom dictionaries, transcripts, summaries, and other content that you provide or create through the Services ("User Content").

You grant FastTrackAI a limited license to process, transmit, store, reproduce, and otherwise use User Content only as reasonably necessary to operate, secure, maintain, support, and provide the Services, or as otherwise described in our Privacy Policy.

This license does not transfer ownership of your User Content to FastTrackAI.

You represent that you have the rights and permissions necessary to submit User Content and use it through the Services.

You are responsible for ensuring that your use of User Content complies with applicable privacy, confidentiality, intellectual-property, and professional obligations.

9. AI Processing, Privacy, and User Consent
The Services offer different AI processing methods depending on the application, device compatibility, subscription plan, and selected features.

On-Device AI — Plus Plan
On compatible devices, the Plus Plan uses Apple's on-device Foundation Models to generate summaries locally.

Audio transcription is performed on the user's device. Information processed through the on-device AI option is not transmitted to Google Gemini for summary generation.

Cloud-Based AI — Pro Plan
The Pro Plan provides access to Google's Gemini AI service for cloud-based summary generation.

When you choose Google Gemini, FastTrackAI transmits text information necessary to generate your requested summary, including:

• The recording transcript.

• Custom dictionary terms.

• AI prompts and summary instructions.

Original audio recordings and photos are not transmitted to Google Gemini.

Automatic Personal Information Anonymization
Before transmitting a transcript to Google Gemini, FastTrackAI uses automated technology to identify and mask certain personally identifiable information, including names, phone numbers, email addresses, street addresses, and other sensitive identifiers.

Automated anonymization may not detect every instance of personal or sensitive information. Users remain responsible for considering the information included in their recordings, transcripts, dictionaries, and other content.

Pro Plan Subscription and Gemini Consent
A Pro Plan subscription provides access to Google Gemini AI summary generation, subject to available credits and applicable usage limits.

Purchasing the Pro Plan does not automatically authorize the transmission of user information to Google Gemini.

Google Gemini processing requires separate, affirmative user consent. Before requesting that consent, the app identifies Google Gemini and explains what information will be transmitted and why.

Users may decline or withdraw consent through the app's Settings. Without consent, Gemini processing is unavailable, but other eligible app features remain accessible.

Google Gemini processes transmitted information under Google's applicable terms and privacy policies.

Additional information is available in our Privacy Policy.

10. Cloud Storage and Synchronization
FastTrackAI is implementing functionality to synchronize users' summaries, transcripts, photos, custom dictionaries, and related information across multiple devices, allowing users to access their information from iPhones, iPads, desktop computers, and laptops.

FastTrackAI uses Google Cloud and Firebase infrastructure for account management and is implementing secure cloud storage and synchronization.

As synchronization functionality becomes available, User Content and associated account information may be transmitted to and stored on Google Cloud and Firebase servers to provide access across supported devices.

Original audio recordings are not uploaded as part of cloud synchronization.

Users are responsible for maintaining the security of their accounts and devices.

Cloud synchronization may depend on internet connectivity, account status, device compatibility, and service availability.

FastTrackAI does not guarantee that synchronization will always be instantaneous, uninterrupted, or error-free.

11. Subscription Plans, Free Trials, and Payments
Certain Services or features require a paid subscription.

FastTrackAI currently offers or may offer the following subscription plans:

Plus Plan
The Plus Plan provides access to eligible on-device transcription and AI summarization features using Apple's on-device technology, subject to device compatibility and available features.

The Plus Plan does not include Google Gemini cloud summary processing unless separately offered.

Pro Plan
The Pro Plan provides access to eligible on-device features and Google Gemini cloud-based AI summary generation, subject to available credits and applicable usage limits.

The Pro Plan includes a monthly allowance of AI credits as described in Section 12.

Subscription Pricing
Subscription prices, available plans, trial periods, and promotional offers are displayed in the application before purchase.

Current standard pricing may include:

• Plus Plan: $4.99 per month.

• Pro Plan: $8.99 per month.

Annual subscriptions, introductory offers, organizational promotions, and other pricing options may also be offered.

The price and terms displayed at the time of purchase govern the applicable subscription, subject to any subsequent changes permitted by the subscription provider and applicable law.

Free Trials
FastTrackAI may offer a standard 14-day free trial and may provide additional promotional trial periods to selected users or organizations.

Trial eligibility, duration, available features, and applicable credit allowances may vary by offer.

Unless otherwise stated in the applicable offer, a free trial associated with an automatically renewing subscription converts to a paid subscription unless canceled before the trial ends.

Automatic Renewal and Cancellation
Subscriptions purchased through Apple's App Store are managed through the user's Apple account.

Subscriptions may automatically renew unless canceled through the applicable subscription provider before renewal.

Deleting an application or deleting a FastTrackAI account does not automatically cancel an active App Store subscription.

Payments, renewal, cancellation, and refunds are subject to Apple's applicable terms and any mandatory consumer protections.

12. AI Credits and Metered Usage
Certain cloud-based AI features operate using a credit-based usage system.

AI credits are units used to measure access to metered processing services. They are not currency, stored monetary value, or a transferable financial asset.

Monthly Pro Plan Credit Allowance
The standard Pro Plan includes an allowance of 7,000 AI credits per subscription month, unless a different allowance is disclosed in the applicable subscription offer.

Credits are used when users request eligible metered services, including Google Gemini summary generation and, when available, optional cloud-based transcription.

Google Gemini Summary Credits
The standard credit charge for generating a summary using Google Gemini is:

5 credits per summary + 1 credit per minute of recording.

For example:

• A 10-minute recording requires approximately 15 credits.

• A 30-minute recording requires approximately 35 credits.

• A 60-minute recording requires approximately 65 credits.

Credit charges may be calculated using the recording duration and the applicable billing rules displayed in the Service. Any rounding method or minimum charge will be disclosed where relevant.

The Services may introduce different credit charges for additional features, specialized processing, or new AI services.

Cloud-Based Transcription
Audio transcription is ordinarily performed locally on compatible devices.

FastTrackAI is implementing optional cloud-based transcription functionality for supported platforms and circumstances where local transcription is unavailable or unsuitable.

When available, cloud transcription may consume additional credits separately from Gemini summary generation.

The applicable credit rate will be disclosed before users authorize cloud transcription.

Cloud transcription may require separate user consent for transmitting audio to a third-party processing service. This is distinct from the Google Gemini summary-processing consent described in Section 9.

Shared Credit Balance
Where supported, AI credits are associated with the user's FastTrackAI account and may be used across FastTrackAI: Smart Notes, RealEstateAI, and ShelterAI.

A single shared credit balance may apply across the three applications rather than providing separate monthly allowances for each application.

Users do not receive additional monthly credits merely by installing or accessing multiple FastTrackAI applications using the same account.

Credit Deduction and Availability
Credits are deducted when eligible metered processing is performed, according to the applicable credit schedule.

Users must have sufficient available credits to initiate a metered operation unless the Service expressly permits another arrangement.

FastTrackAI may display estimated credit charges, remaining balances, and usage information within the Services.

Changes to Credit Allowances and Rates
FastTrackAI may adjust monthly credit allowances, usage rates, or the features that consume credits to reflect changes in technology, processing costs, or service offerings.

Changes will be communicated where required by law.

Changes to credit allowances will not retroactively reduce an annual subscriber's guaranteed monthly credit allowance during the annual subscription term in which that allowance was purchased.

For example, a user who purchases an annual Pro Plan that includes 7,000 credits per month will continue to receive that monthly allowance for the remainder of the paid annual term, even if the standard allowance for new subscriptions subsequently changes.

Applicable credit allowances and rates for a renewed subscription term will be disclosed as required by law.

13. Additional Credit Purchases and Top-Ups
FastTrackAI may allow Pro Plan subscribers to purchase additional AI credits when their included monthly allowance is insufficient.

These additional purchases are referred to as credit top-ups.

Top-ups may be offered at different price points, including $10, $25, and $50, subject to availability.

The number of credits provided with each top-up will be displayed before purchase.

Top-Up Terms

• Top-ups supplement the user's available AI credit balance.

• Top-up credits may be used for eligible metered AI features supported by the user's subscription and account.

• Purchasing additional credits does not automatically change the user's subscription plan.

• Top-up purchases are subject to the applicable payment provider's purchase and refund rules.

• Credits cannot be exchanged for cash or transferred to another user unless FastTrackAI expressly permits it.

• Any expiration dates, rollover rules, or restrictions applicable to purchased credits will be disclosed before purchase.

FastTrackAI may modify or discontinue top-up offerings, subject to applicable law and any rights associated with credits already purchased.

14. Credit Balances, Renewal, and Account Closure
Monthly subscription credit allowances are associated with the applicable subscription billing period.

The Services will display or otherwise disclose the applicable rules governing unused monthly credits, credit renewal, and any carryover.

Purchased top-up credits may be subject to different terms from credits included with a subscription.

If a subscription expires, is canceled, or is otherwise inactive, access to Pro Plan features and the ability to use credits for those features may be restricted.

Deleting an account may result in the loss of unused subscription credits and purchased credits, subject to applicable law and any refund rights.

FastTrackAI will disclose applicable expiration and forfeiture rules before offering credit top-ups for purchase.

15. Intellectual Property
The Services, including software, code, interfaces, designs, trademarks, logos, graphics, documentation, prompts, workflows, and other FastTrackAI content, are owned by FastTrackAI, LLC or its licensors and are protected by applicable intellectual-property laws.

Your use of the Services does not transfer ownership of FastTrackAI intellectual property to you.

ShelterAI®, FastTrackAI®, RealEstateAI™, and other FastTrackAI names, marks, and branding may not be used without authorization except as permitted by law.

16. Cross-Promotion, Marketing Relationships, and Affiliated Businesses
FastTrackAI may promote products, services, educational resources, content, discounts, or other offerings provided by Pet Friendly Network, LLC, a separate company under common ownership, and Pet Friendly Network may promote FastTrackAI products and services.

FastTrackAI may also enter into promotional, referral, affiliate, co-marketing, sponsorship, or other marketing relationships with third parties.

The presence of a promotion, advertisement, link, referral, or third-party offer does not constitute an endorsement or guarantee by FastTrackAI unless expressly stated otherwise.

FastTrackAI and Pet Friendly Network remain separate legal entities. Other third parties remain independent from FastTrackAI unless expressly stated otherwise.

Any collection, use, or disclosure of personal information associated with marketing activities is governed by our Privacy Policy and applicable marketing preferences.

17. Third-Party Services and Links
The Services may integrate with or provide access to third-party platforms, AI providers, authentication providers, payment providers, websites, or other external services.

These providers may include Apple, Google, Firebase, Google Cloud, Google Gemini, Superwall, and other providers supporting the Services.

FastTrackAI does not control all aspects of third-party services and is not responsible for their independent acts, omissions, content, availability, security, or privacy practices to the extent permitted by applicable law.

Your use of third-party services may be subject to separate terms and privacy policies.

18. Acceptable Use
You agree not to use the Services to:

• Violate applicable law.

• Infringe intellectual-property, privacy, publicity, or other rights.

• Upload or distribute malicious software.

• Attempt unauthorized access to systems or accounts.

• Interfere with operation or security of the Services.

• Circumvent subscription, credit-metering, or payment mechanisms.

• Misrepresent AI-generated content in an unlawful or fraudulent manner.

• Use the Services in a manner that could materially harm FastTrackAI, other users, or third parties.

19. Service Availability and Changes
We work to provide reliable Services, but no software, recording system, AI service, network, or electronic storage system is completely fail-safe.

Recordings, transcription, AI processing, cloud synchronization, or other functions may occasionally be interrupted by device failure, power loss, connectivity problems, operating-system behavior, third-party outages, software errors, or other circumstances.

We may modify, add, remove, suspend, or discontinue features, AI models, integrations, subscription plans, or Services.

Where required by law, we will provide appropriate notice of material changes.

20. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

FASTTRACKAI DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

WE DO NOT WARRANT THAT AI-GENERATED OUTPUTS WILL ALWAYS BE ACCURATE, COMPLETE, OR APPROPRIATE FOR A PARTICULAR PURPOSE.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

21. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FASTTRACKAI, LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITY, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FASTTRACKAI'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FASTTRACKAI FOR THE APPLICABLE SERVICE DURING THE PRECEDING TWELVE MONTHS OR FIFTY DOLLARS ($50).

These limitations do not apply where prohibited by law.

22. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless FastTrackAI, LLC and its officers, managers, employees, contractors, and agents from claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful use of the Services, your User Content, your violation of these Terms, or your violation of another person's rights.

23. Termination
You may stop using the Services at any time.

FastTrackAI may suspend or terminate access if you materially violate these Terms, use the Services unlawfully, threaten the security or operation of the Services, or where suspension or termination is otherwise reasonably necessary.

Termination or account deletion does not automatically cancel an active subscription managed through Apple's App Store.

Provisions that by their nature should survive termination will survive, including provisions concerning ownership, payment obligations, disclaimers, limitations of liability, and indemnification.

24. Assignment
You may not assign or transfer these Terms or your rights under them without FastTrackAI's prior written consent.

FastTrackAI may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, corporate reorganization, sale of assets, change of control, or transfer of all or substantially all of the business or assets associated with the Services, or as otherwise permitted by applicable law.

These Terms will bind and benefit the parties and their respective permitted successors and assigns.

25. Apple App Store Terms
For applications obtained through Apple's App Store, you acknowledge that these Terms are between you and FastTrackAI, LLC, not Apple. FastTrackAI, not Apple, is responsible for the application and its content.

FastTrackAI is responsible for maintenance and support for the application as required by applicable law. Apple has no obligation to provide maintenance or support.

To the extent any warranty exists that cannot legally be disclaimed, and the application fails to conform to that warranty, you may notify Apple, and Apple may refund the applicable purchase price as provided by Apple's terms.

To the maximum extent permitted by law, Apple has no other warranty obligation concerning the application.

FastTrackAI, not Apple, is responsible for addressing claims relating to the application, including product-liability claims, claims concerning legal or regulatory requirements, and claims arising under applicable consumer-protection or privacy law.

FastTrackAI, not Apple, is responsible for investigating, defending, settling, and resolving third-party intellectual-property infringement claims concerning the application.

You must comply with applicable third-party terms when using the application.

Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to applications obtained through the App Store and may enforce the applicable provisions against you.

26. Export and Legal Compliance
You may not use or export the Services except as authorized by United States law and the laws applicable where the Services are obtained or used.

You represent that you are not located in a jurisdiction subject to applicable U.S. government embargo restrictions and are not listed on an applicable U.S. government prohibited or restricted-party list.

27. Changes to These Terms
We may update these Terms as our Services, technology, subscription offerings, credit-metering policies, or legal requirements change.

When required, we will provide notice of material changes.

Your continued use of the Services after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.

28. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Subject to any non-waivable rights available to you under applicable consumer-protection or other law, any legal action arising out of or relating to these Terms or the Services shall be brought in a state or federal court of competent jurisdiction located in St. Johns County, Florida, and the parties consent to the jurisdiction of those courts.
