These Terms of Use constitute a legally binding End User License Agreement (“EULA”) between you (“User,” “you”) and FastTrackAI, LLC (“Company,” “Licensor,” “we,” “our,” or “us”) governing your use of the RealEstateAI mobile application (the “Licensed Application”).

By downloading, installing, accessing, or using the Licensed Application, you agree to be bound by this EULA. If you do not agree, do not use the Licensed Application.

1. Acknowledgment
You acknowledge that this EULA is concluded solely between you and FastTrackAI, LLC, and not with Apple Inc. Apple is not responsible for the Licensed Application or its content.

2. Scope of License
Licensor grants you a non-exclusive, non-transferable, non-sublicensable license to use the Licensed Application on any Apple-branded products that you own or control, as permitted by the App Store Usage Rules.

You may not distribute or make the Licensed Application available over a network where it could be used by multiple devices simultaneously. You may not copy, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application, except where such restriction is prohibited by applicable law.

3. Ownership
The Licensed Application is licensed, not sold. All rights, title, and interest in and to the Licensed Application remain the exclusive property of FastTrackAI, LLC. No ownership rights are transferred to you.

4. Subscription Access and Versions
Free Trial
A time-limited Free Trial may be offered. Continued access to the Licensed Application after the Free Trial expires requires an active paid subscription.

Subscription Plans

• Plus Subscription:
  Uses Apple Foundation Models with all AI processing occurring entirely on the user’s device.

• Pro Subscription:
  Includes optional access to cloud-based artificial intelligence services, such as Google Gemini. Cloud-based AI features are opt-in only and are never enabled by default. Personally identifiable information is automatically redacted prior to any cloud transmission.

Licensor may modify, add, or remove features or supported AI models at any time without liability.

5. Consent to Use of Data
You agree that Licensor may collect and use technical data and related information, including device, system, and application software information, gathered periodically to facilitate software updates, product support, and related services. Such data is handled in accordance with the FastTrackAI Privacy Policy.

6. Artificial Intelligence Disclaimer
The Licensed Application uses artificial intelligence technologies for transcription, summarization, and report generation.

You acknowledge and agree that:

• AI-generated outputs may be inaccurate, incomplete, or misleading

• Outputs are provided solely as productivity aids

• AI-generated content is not a substitute for independent review or professional judgment

You are solely responsible for verifying the accuracy, completeness, and suitability of all AI-generated outputs before using them in any professional or client-facing context.

7. Third-Party Services
The Licensed Application may enable access to third-party services, including cloud-based AI providers (“External Services”). Use of External Services is at your sole risk. Licensor is not responsible for examining or evaluating the content, accuracy, availability, or reliability of any External Services and shall not be liable for any acts or omissions of third parties.

Licensor reserves the right to modify, suspend, or discontinue access to External Services at any time without notice or liability.

8. Disclaimer of Warranties
THE LICENSED APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT.

9. Limitation of Liability
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION.

LICENSOR’S TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE FEES PAID BY YOU FOR THE MOST RECENT SUBSCRIPTION PERIOD OR (B) FIFTY DOLLARS ($50.00), EXCEPT AS REQUIRED BY APPLICABLE LAW.

10. Indemnification
You agree to indemnify and hold harmless FastTrackAI, LLC from any claims, damages, losses, liabilities, or expenses arising from your use of the Licensed Application or your violation of this EULA.

11. Export Control
You may not use or export the Licensed Application except as authorized by United States law and the laws of the jurisdiction in which the Licensed Application was obtained. You represent that you are not located in a U.S.-embargoed country and are not listed on any U.S. government restricted party list.

12. Government End Users
The Licensed Application and related documentation are “Commercial Items” consisting of “Commercial Computer Software” and “Commercial Computer Software Documentation,” licensed to U.S. Government end users with only those rights granted to all other end users.

13. Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms.

14. Professional and Real Estate Disclaimer
The Licensed Application is not a licensed real estate broker, agent, attorney, or financial advisor. It does not provide legal, financial, or real estate advice. You are solely responsible for compliance with all applicable laws, regulations, MLS rules, fair housing requirements, and client confidentiality obligations.

15. Updates and Modifications
Licensor may update or modify the Licensed Application or this EULA at any time. Continued use of the Licensed Application constitutes acceptance of any changes.

16. Governing Law
This EULA is governed by the laws of the State of California, excluding its conflict-of-law provisions, except where applicable law requires otherwise. The United Nations Convention on the International Sale of Goods does not apply.
